When you access or use Actaskin or any website platform through which Actaskin is made available (collectively referred to as the "Platform"), you agree to be bound by these terms and conditions, including any terms and conditions incorporated by reference ("Terms"). 

Access to and use of this Platform is provided by Actaskin Pty Ltd ABN 44 667 017 101 (we, our or us) on the following Terms.  It is available at: www.actaskin.com and may be available through other addresses or channels.

We reserve the right to change these Terms, the Platform and any content available on or accessible from this Platform ("Content") at any time by publishing these changes online at www.actaskin.com. By continuing to use the Platform, you are taken to have accepted any changes to these Terms.

Licence to use our Site: We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable licence to use our Site in accordance with these Terms.  All other uses are prohibited without our prior written consent.

You must not use our Site, or any of the Content, for commercial purposes, including any advertising or advertising revenue generation activity on your own website or any other platform, without obtaining a licence to do so from us.

 

User Content: You may be permitted to post, upload, publish, submit or transmit relevant information and content (User Content) on our Site.  By making available any User Content on or through our Site, you grant to us a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free licence to use the User Content, with the right to use, view, copy, adapt, modify, distribute, license, sell, transfer, communicate, publicly display, publicly perform, transmit, stream, broadcast, access, or otherwise exploit such User Content on, through or by means of our Site.

You agree that you are solely responsible for all User Content that you make available on or through our Site.  You represent and warrant that:

We do not endorse or approve, and are not responsible for, any User Content. We may, at any time (at our sole discretion), remove any User Content.

"Actaskin" and any other trade marks associated with Actaskin, are trade marks owned by Actaskin Pty Ltd or its related bodies corporate. You may not use our trade marks without our written consent. Third party trade marks which feature on the Platform, such as Partner trade marks, are owned by the respective third party. The use of a third party trade mark on our Platform does not indicate any association with, or endorsement by Benefit Pocket, of that third party or its goods or services.

Our Site may contain links to websites operated by third parties.  Unless expressly stated otherwise, we do not control, endorse or approve, and are not responsible for, the content on those websites.  You should make your own investigations with respect to the suitability of those websites.

We reserve the right to modify, suspend, or discontinue any aspect of this website, its content, or product offerings at any time.

This includes, but is not limited to, liability for:

Indemnity

You agree to indemnify Actaskin and its related entities (collectively, the "Indemnified Parties") against any liability, cost, expense, loss, or damage suffered as a direct or indirect result of:

·       Any fraud, wilful misconduct, or breach of this agreement by you.

·       Your violation of intellectual property rights or misuse of Actaskin’s content.

Conversely, Actaskin indemnifies you against any liability, cost, expense, loss, or damage suffered as a result of fraud or wilful misconduct by Actaskin.

However, a party’s liability under this indemnity is reduced to the extent that the loss or damage arises from:

·       The other party’s breach of this agreement.

·       A wrongful, negligent act or omission by the other party or its employees, agents, or contractors.

Shipping & Delivery

·       Shipping Locations: We currently ship within Australia. Delivery timelines may vary based on location.

·       Delivery Timeframes: Estimated delivery times are provided at checkout. We are not responsible for delays caused by courier services.

·       Shipping Fees: Shipping costs are calculated at checkout. Free shipping may be available on certain products or orders.

·       Lost/Damaged Parcels: If your order is lost or arrives damaged, please contact us within 3 days with your order details and photos (if applicable).

 

Returns & Exchanges

You have rights under the Australian Consumer Law in relation purchases from Actaskin, including rights to refunds, replacements and repairs in certain circumstances. Subject to your rights, we will only offer refunds if it meets the below requirements:

·       Return Eligibility: We accept returns within 7 days of purchase if the product is unopened, unused, and in original packaging.

·       Non-Returnable Items: Opened, used, or promotional items are not eligible for returns, unless they are defective.

·       Return Process: Customers must contact us at hello@actaskin.com before sending any returns. Return shipping costs are the buyer’s responsibility unless the return is due to a defect or error on our part.

·       Refunds: Approved refunds will be processed to the original payment method within 7-14 business days after we receive the returned item.

We offer a 30-day money back guarantee on your first purchase of Sun Repair. If you have taken the product as directed (two tablets daily for 30 consecutive days) and have not experienced any improvement in your skin health or appearance, you may request a refund of the purchase price.

Subscription Terms

Actaskin offers subscription services for select products. By subscribing, you agree to the following terms:

1.     Subscription Payments & Renewals

·       Subscriptions are billed automatically based on the chosen frequency (e.g., monthly, quarterly).

·       You authorise recurring charges to your selected payment method until you cancel your subscription.

 

2.     Subscription Cancellation & Refunds

·       You may cancel your subscription by 11:59 PM before the applicable order processing date to receive a refund for the upcoming charge. If you cancel after this deadline, you will be charged for that cycle, and your subscription will continue until the next billing period.

·       Refunds, if applicable, will be made using the original payment method. We cannot process refunds to alternative cards or payment methods.

·       If you cancel a paid subscription, it will remain active until the end of your current subscription period, and any products already paid for will be delivered unless otherwise agreed.

Preorder Policy
Some Actaskin products may be offered on preorder. Preorders allow customers to reserve upcoming stock before it arrives. When you purchase a preorder item, you are authorising Actaskin to collect full payment at checkout to secure your allocation.

The estimated shipping date for each preorder item will be displayed on the product page. This date is an estimate only and may change due to manufacturing or carrier delays. If the timeframe changes, Actaskin will notify affected customers by email.

If your order contains both preorder and in-stock items, the full order will ship together once all items are available, unless you choose to pay an additional shipping fee to split the shipment.

You may cancel your preorder and receive a full refund at any time before the item has shipped.

By placing a preorder, you agree to these terms.

·       Allergy Disclaimer: Customers are responsible for reviewing ingredient lists and conducting patch tests before full use.

Termination      

These Terms are effective until terminated by us, which we may do at any time and without notice to you.  In the event of termination, all restrictions imposed on you by these Terms and limitations of liability set out in these Terms will survive.

Governing Law

Your use of our Site and these Terms are governed by the laws of the State of Queensland, Australia.  You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in the State of Queensland, Australia and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.

Our Site may be accessed throughout Australia and overseas.  We make no representation that our Site complies with the laws (including intellectual property laws) of any country outside Australia.  If you access our Site from outside Australia, you do so at your own risk and are responsible for complying with the laws of the jurisdiction where you access our Site.
